ASSOCIATION MAT-RE

L’association MAT-Ré (« Mer Air Terre » – île de Ré) a déposé plainte contre X auprès du Parquet National Financier (PNF), enregistrée le 16 avril 2018, pour non-respect des procédures d’appel d’offres et favoritisme, suite à l’enquête préliminaire diligentée par la Police Judiciaire (Antenne de Nantes), au sujet des frais d’avocats, près de 700 000 euros, au profit de Maître Kalima Kasmi, avocate inscrite au Barreau de Nantes, versés par la Communauté de communes (CDC) de l’île de Ré, entre 2010 et 2015.

Rappelons que la Communauté de communes de l’île de Ré a versé près de 50 000 euros à Maître Kasmi (cf rapport d’observations définitives de la Chambre régionale des comptes de Bordeaux, présidée par Monsieur Jean-François Monteils) pour un recours contre la cimenterie HOLCIM (LAFARGEHOLCIM), déposé par les Collectivités de l’île de Ré (CDC et commune de Rivedoux) le 5 décembre 2011, qui a eu pour conséquence d’entraîner l’annulation de l’autorisation d’exploiter la cimenterie assortie de la possibilité de déposer une nouvelle demande d’autorisation, qui s’est traduit par l’obtention d’une nouvelle autorisation d’exploiter en 2016. En même temps, Monsieur Patrice Raffarin, Maire de la commune de Rivedoux-Plage, lors de l’enquête publique conduite en 2016, s’est déclaré favorable au projet cimentier comprenant 4 tours de près de 70 mètres de hauteur, sans modification significative en comparaison avec le projet initial. 

A notre connaissance, les recours ont été abandonnés par les Collectivités. En comparaison, les honoraires versés à Maître Hervé Pielberg, l’un des meilleurs avocats en Droit public, ont été entre 5 et 10 fois moins importants, toute chose égale par ailleurs, que les sommes versées par les Collectivités à leur(s) avocat(s), aux frais des contribuables rétais.

Lors de l’audience du 15 mai 2018, le rapporteur public de la Cour administrative d’Appel de Bordeaux a préconisé l’annulation de l’autorisation d’exploiter du 6 décembre 2010, au bénéfice de l’association MAT-Ré et requérants, sans l’assortir de la possibilité de solliciter une nouvelle autorisation. Nous attendons le délibéré dans les jours à venir et les décisions de justice quant à la validité et pérennité de la nouvelle autorisation d’exploiter délivrée par le préfet de la Charente-Maritime en 2016.

Dès lors, l’association MAT-Ré envisage de s’adresser à Monsieur Edouard Philippe, Premier Ministre, pour attirer son attention sur les risques de destruction de la biodiversité d’un tel projet cimentier à proximité immédiate de l’île de Ré, de ses plages et activités primaires, afin qu’une nième autorisation ne puisse être délivrée par l’Etat, à la nième entreprise qui porterait ce projet, « véritable défi au bon sens, à l’éthique et à l’esthétique, comportant des risques de pollution ».
