50 adhérents étaient présents ou représentés suite à l’Arrêt de la Cour administrative d’Appel (CAA) de Bordeaux du 12 juin 2018 qui a annulé l’autorisation d’exploitation datant du 6 décembre 2010 de la cimenterie ex-HOLCIM à La Rochelle face à l’île de Ré sans l’assortir de la possibilité pour l’industriel de déposer un nouveau dossier. Or les Collectivités de l’île de Ré et la commune de Rivedoux avait engagé un recours qui a eu comme conséquence l’obtention d’une nouvelle autorisation en 2016 pour laquelle le maire de la commune de Rivedoux-Plage a donné un avis favorable (ainsi que son conseil municipal) lors de l’enquête publique afférente alors « qu’en même temps », il aurait versé des honoraires à un avocat pour au contraire la contester.

Notre avocat, Maître Hervé Pielberg, considère que cette autorisation de 2016 est fragilisée par l’Arrêt de la CAA de Bordeaux et envisage de s’adresser au Tribunal administratif de Poitiers pour obtenir son annulation.

Dans le même temps, nous attendons la décision de l’industriel d’un Pourvoi en Cassation qui ne sera pas forcément accepté par le Conseil d’Etat.

En conclusion, il apparaît que l’industriel pourrait devoir stopper toute exploitation dans les prochains mois et nous considérons d’ailleurs que la cimenterie tourne au ralenti depuis 3 ans.

Parallèlement, l’association MAT-Ré a déposé plainte contre X au Parquet National Financier pour « arrangements financiers » dans l’industrie du ciment et pour les dépenses d’avocats des Collectivités concernant le recours contre HOLCIM. Il convient de rappeler la mise en examen de LAFARGE et de plusieurs cadres dirigeants pour complicité de « Crimes contre l’Humanité » et financement de terrorisme.

En dernier ressort, l’industriel pourrait solliciter une 3ème autorisation d’exploiter mais notre avocat considère que l’Etat pourrait avoir des réticences à persister en ce sens dans le contexte actuel.
